Personal data are all information relating to an identified or identifiable natural person. This includes, for example, information such as your name, your phone number, your email or IP address. Information that we cannot relate to your person, e.g. by anonymizing the information, is not personal data.
We generally commit ourselves to the principle of data minimization. Data is only collected, processed, stored or transmitted by us to the extent necessary for initiating or carrying out business.
The processing of personal data always requires a legal basis or your consent. Your personal data provided in the course of initiating or conducting business is processed exclusively for these purposes in accordance with the applicable data protection provisions by our internal systems. Processed personal data will be deleted as soon as the purpose of processing has been achieved and no legally required retention obligations have to be observed.
If you give consent, you can revoke your consent without giving reasons while maintaining confidentiality directly at the following email address data-protection@fms-logistics.com. In case of revocation, your data covered by the consent will be deleted immediately. However, within the scope of a business relationship, we reserve the right to collect and request purpose-related personal data (phone number, email address) from you if necessary.

If you are in a business relationship with FMS, your data, as far as necessary, will be passed on to the relevant department or necessary internal systems for order processing. Your personal data will only be passed on to the extent necessary for efficient processing of your order.
Your data is stored on internal FMS servers. Access to your data is only possible by authorized persons in the context of the business relationship and by employees in the IT Operations department, as far as this is necessary to maintain the system (especially maintenance and repair work) and to ensure data security. All persons authorized to process personal data who can access your data are obliged to maintain confidentiality according to legal regulations. Your data will only be passed on to third parties (e.g., authorities) insofar as this is legally permissible, for example when the transfer is necessary to fulfill a legal obligation to which FMS is subject (Article 6 (1) lit. c GDPR).
Your personal data will be deleted as soon as they are no longer necessary for the handling of a mutual business relationship. This does not apply if your personal data is subject to statutory retention obligations that require the data to be stored beyond the duration of the business relationship.
FMS has taken appropriate technical and organizational measures, considering the state of the art, the risks arising from the processing, and the protection of your data, to protect the personal data you provide in accordance with legal regulations, particularly Article 32 of the GDPR.
As a business partner, you are a data subject within the meaning of the GDPR, and you have the following rights against FMS:
You have the right to access information about your personal data stored by FMS, which you can exercise by emailing our data protection officer at data-protection@fms-logistics.com. The information should include a copy of your data that, besides the existing data about you, also includes the recipients of the data, the purpose of storage, and all other legally required information according to Article 15 GDPR. At your special request, the data will be made available in a structured, commonly used, and machine-readable format. The responsible IT department sets the standard for this.
You have the right to have your personal data corrected if it proves to be incorrect. Likewise, you can request the completion of incomplete personal data.
You have the right to deletion of your personal data under the following conditions:
The knowledge of the data is no longer necessary for the fulfillment of the purpose of storage;
You have withdrawn consent, and there is no other legal basis for processing;
The processing of personal data is unlawful;
You invoke a right to object based on a specific – to be justified – personal situation;
It concerns special personal data whose accuracy cannot be proven, or
There is another legal obligation to delete the data.
If there is an obligation to delete and the personal data have previously been made public, other data controllers should be informed about your request for deletion regarding all copies of your data.
You can request the restriction of processing of your data if
You dispute the accuracy of the personal data concerning you for a period that allows FMS to verify the accuracy of the personal data;
The processing is unlawful and you refuse to delete the personal data and instead request the restriction of the use of personal data;
FMS no longer needs the personal data for the purposes of processing, but you need it to assert, exercise or defend legal claims, or
If you have lodged an objection to processing in accordance with Article 21(1) GDPR and it is not yet clear whether FMS’s legitimate reasons outweigh your reasons.
If the processing of personal data concerning you has been restricted, these data may be processed – apart from their storage – only with your consent or for the assertion, exercise or defense of legal claims or for the protection of the rights of another natural or legal person or for reasons of significant public interest of the Union or a Member State.
If the restriction of processing has been restricted according to the above conditions, FMS will inform you before the restriction is lifted. We will inform you about all measures taken in response to your respective request within one month at the latest.
If you believe that the processing of personal data concerning you violates the GDPR, you have the right to lodge a complaint with the competent supervisory authority.
Changes to legal regulations or internal business processes may require an adjustment of this privacy policy. Changes to this policy are effective without form and will be brought to your attention by FMS in a suitable manner.

The use of our web-based supply chain management system Cargo Cube involves the collection, processing and storage of personal data to a small extent.
We need some of the data to set up and manage your user account or to set up individual services. Other – especially technical – data, however, are automatically collected by our IT systems when you visit the web application. We need this data to ensure error-free provision of the system.
